These rules apply to all products and services made available by BYD HR and will be available to all users. 1. PERSONAL DATA WE MAY COLLECT

BYD HR Selection Process Candidates: Personal information may be collected directly from you or from other sources (professional social networks and supplier websites), through phone calls, virtual interviews, in-person interviews and filling out questionnaires. During the recruitment process we collect personal registration information, professional and academic experience, extracurricular courses, language proficiency, qualifications, skills, training, current and expected remuneration package, test results, references to validate the information and, occasionally, when legally permitted, information about criminal records.

Customers and Suppliers: we collect information about the organization’s contact points (name, position, telephone and email).

2. PURPOSE

The purpose for which we need to process data is to manage the recruitment process, evaluate the suitability of your profile for the position for which you applied and improve the services provided.

We do not use automated decision-making technologies and a member of our team will always be involved in providing recruitment services.

3. ACCESS AND SHARING

Your Personal Information will only be accessed by BYD HR members and/or third parties that provide services to BYD HR who are committed to ensuring data privacy.

Your personal data will only be shared with companies that have the vacancy you applied for or companies that have vacancies and/or positions compatible with your profile.

Sharing will be carried out to the extent necessary to achieve the original purpose for which we collected your data and we will require third parties qualified as data operators with whom we share your personal data to sign a service provision contract with us containing a specific clause on respect for data privacy, in accordance with Law 13,709/2018.

We do not sell or trade the information collected.

4. STORAGE PERIOD

Data will be stored for the period necessary to provide the services or until you request the deletion of your registration. Some data may be stored for a period of 5 (five) years, to comply with legal obligations, government requests, investigations into violations of our terms or policies.

5. YOUR RIGHTS

The Law guaranteed data subjects certain rights in relation to personal information that is under the guardianship of BYD HR, such as:

  • Know what personal data exists with us;
  • Correct, update and/or complete your data;
  • Request the deletion of unnecessary, excessive or illicitly processed data;
  • Revoke your consent when your personal data is processed under this hypothesis.
  • Request portability of your data;
  • Requests will be made free of charge and within the period determined by law. We may request additional information to validate your identity and we may also refuse to comply with your request if it is unfounded, excessive or if we believe it could violate any business secret.

The information processed will be stored safely and completely, in a controlled, monitored and secure environment. The information obtained will be considered confidential and will only be accessed by people authorized by BYD HR.

We use preventive technical and administrative measures to protect your information against unauthorized access, use or disclosure. Among the measures used, we highlight the training and awareness of employees and the use of firewall technologies.

7. LEGAL BASIS

The legal grounds for processing data are:

Fulfillment of a contract: in order to fulfill the obligations we undertake when providing a service to you, or in order to take steps, at your request, to enter into a contract with us, it will be necessary for us to process your personal data;

BYD HR ‘s legitimate interests : Our legitimate interests are to improve our services, inform about new vacancies and ensure that our operations are conducted properly and efficiently;

Legal or regulatory obligation: we are subject to certain obligations under law that may require the processing of your personal data, including disclosure to competent authority;

Your consent: in specific circumstances we may ask for your consent to process your personal data.

8. THIRD PARTY WEBSITE

Our website may contain links that, if clicked, direct you to other websites. If you visit another website from ours, you must read and agree to its privacy policy. We are not responsible for the privacy policy or websites of third parties.
